Terms and Conditions

General

This is a legally binding contract between the property owners, Mr Simon Kearn and Kelly Kearn trading as Hayling Hideaway and the holidaymaker. The property owner is also referred to as "we" and "us". The holidaymaker is the person who makes the payment. This person must be over the age of 18. This person is responsible for ensuring all members of the holiday party accept and adhere to these terms and conditions.

The holidaymaker is also referred to as "you". The property referred to being either:

Bookings

A booking deposit of 15% payable within 24hrs of the provisional booking being taken. The booking is taken on a provisional basis until the deposit has been paid in full and funds cleared through the banking system (where appropriate). The booking then becomes confirmed. Until the booking is confirmed, it can be cancelled at any time without prior notice. You are welcome to pay in full at time of booking should you so wish.

The balance of the rental charge is payable not less than 14 days prior to the start of the holiday. Failure to pay the deposit or balance in full by the due dates will constitute a cancellation of the holiday by the holidaymaker. Please be sure to note the due dates of these payments as reminders are not routinely issued.

Bookings made less than 14 days prior to the arrival date must be paid in full at the time of booking.

Cancellation by the Holidaymaker

Cancellation of the booking by the holidaymaker should be e-mailed to:

In the event of a cancellation, we will attempt to re-let the property and if successful, a refund payment will be made, less an admin fee of £45.00. If we are unable to re-let the property and cancellation is within 13 days of the booking start date, no refund will be provided. We strongly recommend you take out holiday cancellation insurance.

COVID-19 Government Lockdown Cancellation

Under Covid-19 restrictions, if travel is not permitted by the Government, then a full refund will be given.

Cancellation by the Property Owner

The property owner will endeavour to make sure the stated property is available for the dates contracted. In the unlikely event the property becomes not available, and the property owner must cancel the booking, the holidaymaker shall be entitled to a full refund. The property owner shall only be liable to return the monies received. No compensation or consequential losses shall be paid.

We cannot be held responsible for the breakdown of mechanical equipment nor for the failure of public utilities such as Water, Gas and Electricity, but should you as the holidaymaker have to leave the property due to these failing a refund of unused booked days will be given. No compensation or consequential losses shall be paid.

Changes

If you want to change any detail of your confirmed booking, we will do our best to make the changes. However, we must receive your notice by email. We may agree to accept notice over the telephone, but this should be arranged with us first. Also, we cannot guarantee that we will be able to meet your request. Changes can only be accepted according to our terms and conditions. Plus, where we cannot meet your change request, your booking may need to be cancelled, please see our cancellation section.

Cutting short your stay

No refunds are payable, in the event that you or the other guest cut short your stay.

Miscellaneous

Whilst every care is taken to provide a true and accurate description of the property, over time, alterations are made, and some things do change. The holidaymaker accepts that no refunds are available for such discrepancies.

The property owner reserves the right to enter the property, at a reasonable time, in the event of an emergency for remedial repair work being required.

The property owner is entitled to ask the holidaymaker to leave the property without any refund if, in the property owner's opinion, the behaviour of the holiday maker and/or his/her party is unacceptable.

The property owner reserves the right to refuse entry to anyone, who in the property owner's opinion is not suitable to or capable of taking charge of the property.

The property owner reserves the right to ask the holidaymaker and their party to leave the property, without refund, should the behaviour of the holidaymaker and/or their party be considered by the property owner to be unreasonable.

Number of Guests

The maximum number of people entitled to stay at Hayling Hideaway is 2 and furthermore, only those people booked are entitled to stay. If it is found that more people than agreed are using the property, this will be considered a breach of contract and the holidaymaker and his/her party will be asked to leave immediately without any refund. Sub-letting or assignation of the let, is prohibited. Friends of guests who wish to visit are not permitted to stay overnight and communication with the property owner is required prior to any visitors.

Pets

At present we are not allowing pets at the property - but this will hopefully change in due course. 

Internet

Wi-Fi is subject to availability and network conditions. No compensation or consequential losses shall be paid.

Streaming services

Where you access your own streaming services through TVs provided by ourselves, e.g. SKYGO, Now TV etc, it remains your responsibility to ensure that you are logged out when you depart the property. We cannot take responsibility for doing this on your behalf and will not be liable for any subsequent charges made to you in the event of usage by the following guests, if you have forgotten. You should be able to log out remotely by changing your password and logging out of all devices when prompted.

No Smoking

The properties are non-smoking (including E-cigarettes).

CCVT

We use a CCTV cameras to view the external areas surrounding our Property.  There are no cameras within the property itself or covering the back garden area. The recording may be used to identify unauthorised guests, pets, visitors or electric car charging.

Electric Car Charging

Electric charging of your car is not permitted from the electricity supply at the property. Should it be found that this has taken place, you will be asked to cover the additional costs incurred & asked to leave the property for breach of these T&C’s. The property owner retains the right to make a charge for any damage incurred to the property/electrical system.

Arrival and Departure Time

Every effort will be made to have the property available from 2.30pm on the day of arrival. The property must be vacated by 10.30am on the day of departure. Late departure will result in an additional charge being made. Information about keys and how to collect them will be provided once full payment has been received.

Liability

The property owner takes no responsibility for the personal possessions of the holiday maker or the holiday maker's party. Vehicles and possessions are left entirely at the risk of the holidaymaker. Children must always be supervised.

If you leave any property behind, we will use reasonable endeavours to return it to you, although we reserve the right to charge you in advance for any reasonable postal or courier costs. We may dispose of any unclaimed property after six (6) months.

Cleaning

We would like to think the holidaymaker and party would treat the property with care and respect and at the end of the holiday the property is left in a clean and tidy condition. The property owner retains the right to make an additional charge for cleaning should the property not be left in a similar condition to the way it was found at the start of the holiday.

Breakages

The holiday maker should make every effort to keep the property, fixtures and fittings and all contents in the same state of repair and condition as at the start of the holiday. Any accidental damage or breakages should be reported to the property owner (or their representative) prior to departure. The property owner retains the right to make an additional charge for damage and breakages although it should be noted that minor breakages and reasonable wear and tear (in the opinion of the property owner) will not be charged for.

Complaints

Every endeavour is made to ensure your stay with us is memorable for all the right reasons. However, we do recognise that from time to time things do go wrong. In these circumstances, it is the responsibility of the holiday maker to make any such problem known to the property owner (or their representative) immediately it becomes apparent, thereby giving the property owner the opportunity to correct the situation. Unless this procedure is followed, no subsequent claim will be entertained.

The property owner will make every endeavour to rectify any identified problems as soon as is reasonably possible.
